In this Lawsuit, Plaintiffs allege that Ford Motor Company ("Defendant") breached the express warranties covering the 2000 and 2001 model year Ford Focus, violated the federal Magnuson-Moss Warranty Improvement Act, 15 U.S.C. § 2301 et seq., and violated the Song-Beverly Consumer Warranty Act, Cal. Civ. Code, § 1790 et seq.

In particular, Plaintiffs allege that Defendant's 2000 and 2001 Ford Focus contains a defective brake system that causes excessive and premature wear of front brake components, including brake pads and rotors, requiring premature service, repair and/or replacement. Plaintiffs seek to recover money damages from Defendant, including costs for repairs and the diminished value resulting from the alleged defect.

The Defendant denies all allegations of wrongdoing and liability asserted in the Lawsuit and contends that it conducted its dealings with Plaintiffs and Class members in conformity with its express warranty and with all applicable laws.

The Court has certified a class on the warranty claims, but made no determination of who is right or wrong in the Lawsuit. On April 28, 2008 the Court granted preliminary approval of a settlement class on all of Plaintiffs’ claims.
