Plaintiffs allege that the brake system in the model year 2000 and 2001 Ford Focus experiences excessive and premature wear of front brake pads and front rotors, thus requiring repair and/or replacement before normal repair or replacement intervals. All of Plaintiffs’ warranty claims were certified as a class action in February 2007, and the proposed Settlement will resolve all warranty and other claims that could have been brought relating to the premature front brake wear. Defendant denies these allegations and any liability. The Court has made no rulings on whether Plaintiff or Defendant are right or wrong. Members of the class may be eligible for full reimbursement for the costs of parts and labor of qualifying repairs.

- Who is included in the proposed Settlement?
The “Settlement Class” or “Class” is defined as all persons who purchased or leased a new model year 2000 or 2001 Ford Focus vehicle (“Class Vehicles”) in the State of California.
If you fall under this definition, you are a “Class Member,” and you may be entitled to receive benefits under the proposed class settlement. This is the case even if you no longer own or lease the vehicle as long as you owned or leased the vehicle at the time of a qualifying front brake repair and you paid for that brake repair.

- What benefits are Class Members entitled to?
The Proposed Settlement, provides that eligible Class Members who complete and submit a claim form, and provide the required documentation are entitled to receive the following:
Reimbursement for parts and labor for a front brake pad and/or front rotor repair, replacement or rotor resurfacing that occurred within 18,000 miles from the date of purchase/lease of the Class Vehicle, provided that the repair has not already been paid for by Ford or one of its affiliates or dealers;
and/or
all such repairs after the first repair, provided these repairs occurred within three years and 36,000 miles from the date of purchase/lease, and provided that the repair for which the claim is made has not already been paid for by Ford or one of its affiliates or dealers..

- How you can exclude yourself from the proposed Settlement?
If you wish to exclude yourself from the class, you must mail a personally signed, written request to be excluded to the Settlement Administrator at the following address:

Your Request for Exclusion must give your full name and current address, the Vehicle Identification Number (“VIN”) of your vehicle, and specifically state your desire to be excluded from the Settlement Class. Your Request for Exclusion must be postmarked by July 3, 2008. If your Request for Exclusion is not postmarked by that date, you will remain a member of the Settlement Class. If you exclude yourself from the Settlement Class, you will not be able to receive any of the benefits provided by the settlement, or to object to the terms of the settlement. If you exclude yourself from the Settlement Class, you will, retain your right to sue, or continue to sue, Ford regarding the alleged brake system defect.

- How do I object to the Settlement?
You may only object to the Proposed Settlement if you do not exclude yourself from the Class. If you wish to object to the Proposed Settlement, you must provide your objection in writing, and (i) give your full name and current address, (ii) the VIN of your vehicle, (iii) state that you are objecting to the settlement, (iv) state the legal and factual reasons for your objection, and (v) include all documents that support your position. All objections and any supporting papers must be postmarked no later than July 3, 2008, and must be mailed to the following addresses:

- When is the Final Approval Hearing?
On July 28, 2008, at 2:00 p.m., in Department 324, of California Superior Court, 600 South Commonwealth, Los Angeles, California, Judge Victoria Chaney will hold a Fairness Hearing to determine whether to give final approval to the proposed settlement. The Judge will also consider a request by the lawyers representing Class Members for attorneys’ fees and expenses not to exceed $2,600,000, and a payment to the class representatives of up to $7,500 each for their efforts.
